Terms & Conditions

a. You must be at least 18 years old and legally able to enter into a binding contract to use the Service.

b. You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.

c. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@promptvex.online if you believe your account has been accessed without authorization.

d. You may not share your account with others or allow more than one individual to use a single account.

Promptvex is a software-as-a-service platform that helps you analyze AI video prompts and generate visual previews and full videos using third-party AI providers (such as Anthropic, fal.ai, Kling, and Runway). The Service includes prompt scoring, keyframe previews, draft video generation, and routing to full-quality video providers, subject to the limits of your chosen plan.

a. The Service is offered on a subscription basis with multiple paid plans, each including a monthly allowance for analyses, keyframe previews, draft videos, and full videos. A free plan with limited functionality is also available.

b. Plan prices, allowances, and supported providers are shown on the Pricing page and may be changed by us from time to time. Changes will not apply retroactively to the current billing period of an active subscription.

c. Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) until you cancel. By subscribing, you authorize us and our payment processors to charge your selected payment method on a recurring basis for the applicable fees and taxes.

d. Monthly quotas reset at the start of each billing period. Unused allowances do not roll over to the next period and have no cash value.

e. Quota usage that exceeds your plan’s limit will be blocked. Upgrades to a higher plan take effect immediately, and downgrades take effect at the end of the current billing period.

a. Payments are processed by trusted third-party payment providers, including PayHere and Stripe. By providing payment details, you represent that you are authorized to use the payment method and you authorize the relevant processor to charge the full subscription amount, including applicable taxes.

b. We do not store full card or banking details on our servers. Any disputes regarding payment processing are subject to the policies of the relevant payment processor in addition to these Terms.

c. All fees are stated in the currency shown at checkout and are exclusive of taxes unless otherwise stated. You are responsible for any taxes, duties, or charges imposed by your tax authority in connection with your use of the Service.

Refunds and cancellations are governed by our Refund Policy. In summary, subscription fees are non-refundable once a billing period has begun, but you can cancel at any time to stop future charges, and your subscription will remain active until the end of the current period.

You agree not to use the Service to create, upload, generate, store, or distribute any content that:

• Infringes any intellectual-property right, including copyright, trademark, or publicity rights of any third party.
• Depicts a real, identifiable person without their consent, including political figures, celebrities, or private individuals, in a misleading, defamatory, sexual, or deceptive manner (including deepfakes).
• Constitutes child sexual abuse material (CSAM), or sexualizes or endangers minors in any way.
• Promotes terrorism, violent extremism, self-harm, or instructs others in unlawful activity.
• Is harassing, hateful, discriminatory, or threatening towards any individual or group.
• Is fraudulent, deceptive, misleading, or designed to impersonate Promptvex or any third party.
• Contains malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to any system or data.
• Violates the acceptable-use or content policies of any third-party AI provider used by the Service (including Anthropic, fal.ai, Kling, and Runway).
• Violates any applicable law or regulation, including Sri Lankan law.

We may suspend or terminate your account, refuse to process generations, or remove content if we reasonably believe you have violated these Acceptable Use rules.

a. Your content — you retain ownership of the prompts, parameters, and reference materials you submit to the Service (“Inputs”). You grant Promptvex a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process your Inputs solely to operate and improve the Service and to deliver the requested generations.

b. Generated outputs — subject to your compliance with these Terms and the policies of the underlying AI providers, you may use, reproduce, and commercially exploit the outputs you generate through the Service, to the extent permitted by those provider policies. You are responsible for ensuring your use of any output is lawful and does not infringe the rights of others.

c. No guarantee of uniqueness — AI models may produce similar or identical outputs for different users. We make no representation that any output is unique to you.

The Service, including the Promptvex name and logo, software, design, user interface, documentation, and all related materials, is the property of Promptvex or its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you in the Service.

You may not copy, modify, reverse engineer, decompile, sell, resell, or create derivative works based on the Service, except to the extent expressly permitted by applicable law.

The Service depends on third-party AI providers and infrastructure providers, including Anthropic, fal.ai, Kling, Runway, Cloudflare, PayHere, and Stripe. Your use of features that rely on these providers is also subject to their respective terms and policies. Promptvex is not responsible for the availability, content, or practices of third-party providers, but we will use commercially reasonable efforts to maintain reliable integrations.

a. We strive to maintain a reliable Service but do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Scheduled maintenance, third-party outages, network issues, and events outside our reasonable control may cause downtime.

b. We may add, modify, or remove features of the Service at our discretion. Where a change materially reduces the core functionality of an active paid plan, we will use commercially reasonable efforts to provide notice.

a. You may terminate these Terms at any time by cancelling your subscription and discontinuing use of the Service.

b. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, our Refund Policy, our Privacy Policy, or applicable law, or if your account poses a security or legal risk.

c. Upon termination, your right to access the Service ends. Provisions of these Terms that by their nature should survive termination (including those relating to ownership, disclaimers, limitations of liability, and governing law) will continue to apply.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that generated outputs will meet your expectations or any specific creative, commercial, or technical requirement.

AI-generated content can be unpredictable, may contain inaccuracies, and may not be suitable for every use case. You are responsible for reviewing all outputs before use.

To the maximum extent permitted by law:

• Promptvex and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.
• Our total aggregate liability for any claims arising out of or in connection with the Service in any 12-month period will not exceed the greater of (i) the amounts you actually paid to Promptvex for the Service in the 12 months immediately preceding the event giving rise to the claim, or (ii) USD 50.

Some jurisdictions do not allow certain limitations of liability; in such jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Promptvex from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any policy referenced in them; (c) your Inputs or your use of generated outputs; or (d) your violation of any law or the rights of any third party.

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict-of-laws principles. You agree that the courts located in Colombo, Sri Lanka will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may seek injunctive or equitable relief in any court of competent jurisdiction.

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the latest revision. We will use commercially reasonable efforts to notify you of material changes through the Service or by email. Continued use of the Service after a change becomes effective constitutes your acceptance of the revised Terms.
